This Agreement is entered into between Фізична особа ФОП Бізюкіна Катерина Олексіївна, hereinafter referred to as the "Seller", and the user of the online store https://bizyki.com, hereinafter referred to as the "Buyer", and constitutes a distance contract of sale of goods concluded through the online store https://bizyki.com. By placing an Order with the intent to purchase Goods, the Buyer accepts the terms of this Contract of Sale (hereinafter – the "Agreement") under the following conditions:
1. Definitions
1.1. Public Offer (hereinafter – "Offer") means a public proposal by the Seller addressed to an unlimited number of persons to conclude with the Seller a distance contract of sale of goods (hereinafter – "Agreement") on the terms set forth in this Offer, including all Annexes thereto.
1.2. Order means the Buyer's decision to purchase Goods and arrange their delivery, as submitted through the online store.
1.3. Goods means girls' festive dresses, related accessories (sashes, hair clips, tiaras, etc.), and accompanying items listed in the online store https://bizyki.com. Each product description includes fabric composition, size guide, and care instructions.
1.4. Online Store means, in accordance with the Law of Ukraine "On Electronic Commerce", a facility for presenting or selling goods, works, or services by means of an electronic transaction.
1.5. Seller means the company selling the goods presented on the website https://bizyki.com.

1.6. Buyer means a natural person who has concluded the Agreement with the Seller on the terms set out herein.
2. General Provisions
2.1. The information set out below constitutes an official offer (public offer) of the online store https://bizyki.com to any natural person (hereinafter – the Buyer) to conclude a contract of sale of girls' festive dresses and related goods.
This Agreement is a public contract and, pursuant to Article 633 of the Civil Code of Ukraine, its terms are identical for all buyers.
2.2. Pursuant to Article 642 of the Civil Code of Ukraine, the full and unconditional acceptance of the terms of this Offer, which confirms the conclusion of the Contract of Sale on the terms proposed herein, is the act of placing and confirming an Order.
2.3. By placing an Order, the Buyer confirms that they have reviewed and unconditionally accepted the terms of this Offer.
2.4. By entering into the Agreement, the Buyer confirms the following:
(a) the Buyer has fully and completely read and agrees with the terms of this Offer;
(b) the Buyer grants consent to the collection, processing, and transfer of personal data on the terms specified below. Such consent remains valid for the entire term of the Agreement and for an unlimited period after its expiry.
3. Subject Matter of the Agreement
The Seller undertakes to transfer title to the Goods to the Buyer, and the Buyer undertakes to pay for and accept the Goods in accordance with this Agreement. This Agreement governs the sale and purchase of girls' festive dresses and related goods in the online store https://bizyki.com, including:
- the Buyer's voluntary selection of goods (dresses and accessories) in the online store, specifying the desired size, colour, and model;
- the Buyer's independent placement of an Order in the online store https://bizyki.com;
- payment by the Buyer for the Order placed in the online store;
- processing and delivery of the Order to the Buyer in accordance with the terms of this Agreement.
4. Price of Goods
4.1. The price of each item of Goods is indicated on the website of the online store https://bizyki.com. Prices are quoted in the national currency of Ukraine (hryvnia) and include all mandatory charges.
4.2. The Seller reserves the right to unilaterally modify the price of any item of Goods.
4.3. In the event of a price change for ordered Goods, the Seller undertakes to notify the Buyer of such change.
4.4. The Buyer shall have the right to confirm or cancel the Order if the price has been changed by the Seller after the Order was placed.
4.5. The Seller shall not change the price of Goods already paid for by the Buyer.
4.6. The cost of delivery of Goods is indicated by the Seller on the website of the online store https://bizyki.com or communicated to the Buyer by the Operator at the time of placing the Order.
4.7. The Buyer's payment obligations shall be deemed fulfilled upon receipt of funds by the Seller.
4.8. Payments between the Seller and the Buyer shall be made by the methods specified on the website of the online store https://bizyki.com.
5. Order Placement Procedure
5.1. Orders for Goods are placed through the service of the online store website https://bizyki.com.
5.2. Upon registration on the website, the Buyer undertakes to provide the following registration information: full name, delivery address, e-mail address (if available), and contact telephone number.
5.3. The Buyer may place an Order for any item of Goods available in the online store https://bizyki.com. When selecting a dress, the Buyer independently specifies the desired size in accordance with the size guide published on the website. The Seller shall not be liable for an incorrect size selected by the Buyer in disregard of the size guide recommendations.
5.4. Each item may be included in the Order in any quantity.
5.5. If the Goods are out of stock, the Seller shall notify the Buyer (by telephone or e-mail).
5.6. If the Goods are unavailable, the Buyer may substitute them with a similar model or size, decline the item, or cancel the Order.
5.7. The name, quantity, SKU, size, colour, and price of the Goods selected by the Buyer are displayed in the Buyer's shopping cart on the website of the online store https://bizyki.com.
5.8. Acceptance of this Offer by the Buyer is effected by the Buyer entering the relevant details into the registration form on the website https://bizyki.com.
5.9. The Buyer shall be responsible for the accuracy of the information provided when placing the Order, including the correct size and delivery address.
6. Delivery and Transfer of Goods to the Buyer
6.1. The methods, procedure, and timelines for delivery of goods are indicated on the website of the online store https://bizyki.com. The procedure and terms of delivery of the ordered Goods shall be agreed between the Buyer and the online store manager at the time of placing the Order.
6.2. Upon receipt of the Goods, the Buyer shall, in the presence of the courier's representative, inspect the Goods for compliance with their qualitative and quantitative characteristics (product name, size, colour, quantity, completeness, presence of manufacturer's labels and security tags, and integrity of packaging).
6.3. By accepting the Goods and signing the delivery note, the Buyer acknowledges that the Goods have been received in the stated quantity, size, and condition.
6.4. Title to, and the risk of accidental loss or damage of, the Goods shall pass to the Buyer upon receipt of the Goods.
7. Returns Policy
7.1. The Buyer shall have the right to refuse the Goods at any time prior to their transfer, and after transfer – in the manner and on the terms prescribed by the Law of Ukraine "On Consumer Protection".
7.2. A return of Goods of satisfactory quality is permissible provided that the Goods' original appearance and consumer properties are preserved (the dress has not been worn, bears no signs of use, staining, or foreign odours), and that the proof of purchase, original manufacturer's labels, and security tags are intact.
7.3. The Buyer shall have the right to return or exchange Goods within 14 (fourteen) days of purchase pursuant to the Law of Ukraine "On Consumer Protection", provided that the Goods' original appearance, manufacturer's security tags and labels are preserved and proof of payment is available. An exchange is possible for an equivalent item in a different size or colour, subject to availability.
8. Rights and Obligations of the Parties
8.1. The Seller shall have the right to unilaterally terminate the provision of services under this Agreement in the event of the Buyer's breach of its terms.
8.2. The Buyer shall be obliged to pay for and collect the Order in a timely manner in accordance with the terms of this Agreement.
8.3. The Buyer shall have the right to place an Order in the online store, execute an electronic contract, and require the Seller to perform its obligations under this Agreement.
9. Liability of the Parties
9.1. The Parties shall bear liability for non-performance or improper performance of their obligations under this Agreement in the manner prescribed by this Agreement and the applicable legislation of Ukraine.
9.2. The Seller shall not be liable for any damage suffered by the Buyer as a result of improper use or care of the Goods (including failure to follow washing and storage instructions for the garments); for improper or untimely fulfilment of Orders and obligations due to the Buyer's provision of inaccurate information (including an incorrect size or delivery address); or for delays and interruptions in service arising from causes beyond its control.
9.3. In the event of force majeure circumstances, the Parties shall be relieved of their obligations under this Agreement.
9.4. The Parties shall use their best efforts to resolve any disputes exclusively through negotiations.
10. Other Terms
10.1. This Agreement is concluded in Ukraine and is governed by the applicable legislation of Ukraine.
10.2. The online store reserves the right to unilaterally amend this Agreement, subject to prior publication of the updated version on the website https://bizyki.com.
10.3. Payment by the Buyer for an Order placed in the online store constitutes the Buyer's full and unconditional acceptance of the terms of the Contract of Sale (Public Offer).
10.4. Information provided by the Buyer is confidential. The online store uses the Buyer's information solely for the purposes of processing the Order, delivering the Goods, and carrying out settlements.
11. Term of the Agreement
11.1. An electronic contract shall be deemed concluded from the moment the party that submitted the proposal to enter into such contract receives a notice of acceptance of that proposal.
11.2. Prior to its expiry, this Agreement may be terminated by mutual consent of the Parties before the actual delivery of the Goods, by means of a refund of monies paid.
11.3. Either Party shall have the right to unilaterally terminate this Agreement in the event of the other Party's failure to perform its obligations hereunder, and in the cases provided for by the applicable legislation of Ukraine.
